1. Acceptance of Terms

By accessing or using the NovaFrame.Cloud platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including individual developers, teams, and organizations.

2. Description of Service

NovaFrame.Cloud provides managed virtual private server (VPS) hosting services, including compute resources, storage, networking, and management tools. We offer multiple service tiers with varying resource allocations to meet different workload requirements.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach.

4. Billing and Payment

Services are billed on a monthly basis. Charges are based on the service tier and resources provisioned. Payment is processed through our authorized payment provider. Credits are consumed hourly based on active VPS instances. Unused credits do not roll over unless otherwise stated. You are responsible for ensuring your account has sufficient credits to maintain active services.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Distribute malware, viruses, or malicious code
  • Conduct distributed denial-of-service (DDoS) attacks or participate in botnets
  • Send unsolicited bulk email (spam)
  • Host content that infringes intellectual property rights
  • Mine cryptocurrency without prior written approval
  • Engage in port scanning or security probing of other networks
  • Resell services without authorization

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Resource Limits

Each VPS instance is allocated resources according to its service tier. You must not attempt to exceed or circumvent these resource limits. Excessive resource usage that impacts other users or platform stability may result in throttling or suspension.

7. Data and Backups

You are solely responsible for maintaining backups of your data. While we implement reasonable measures to protect data integrity, we are not responsible for data loss due to hardware failure, software errors, or user actions. We strongly recommend maintaining independent backups of all critical data.

8. Service Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms, fail to maintain sufficient account balance, or if required by law. Upon termination, your data may be deleted after a 30-day grace period. You may terminate your account at any time by contacting support.

9. Limitation of Liability

To the maximum extent permitted by law, NovaFrame.Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.

10. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Our uptime commitments are governed by our separate Service Level Agreement (SLA).

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
